that the state department suffered from systemic failures in its response to the threat in benghazi. and it says, insufficient security was present on the ground. the report also looks into the military response to the attack which killed our ambassador and three other americans. defense secretary leon panetta now saying it was clearly a terrorist attack despite early reports blaming it on a protest that got out of hand. >> as always with these kinds of situations there is a mix here but clearly with regards to one of the facilities involved, a direct attack on that facility. i think that there's no question that extremists were involved in those attacks and i think that, you know, we were able to try to respond as best we could at the time. bill: chief intelligence correspondent catherine herridge on the story from the beginning. what does the report conclude, catherine? >> reporter: thai, bill, good morning. it is a scathing report. there are 29 recommendations, five of which are classified. all of which have been accepted by the secretary of state hillary clinton. this report concludes that t

should be speaking more to the loss of brave americans in benghazi, libya, why is she the one that is pinpointed, pinpointed, pointed and with, i think, inappropriate accusations casting aspersions and doing damage to a reputation of service that is undeserving. so my words are simply this, let's be fair. let's carry on our rights as members of congress and speak to the issue of what a tragic incident that occurred in benghazi. if there is a nomination, which i hope there will be, among the many talented people that the president has, it will be his choice, senators that are eager, friends of mine, senator kerry, and others, may have this opportunity. but let us hold to the premise that you are innocent until proven guilty. that someone's great service is deserving of respect, and she is deserving of respect. susan rice is deserving of respect. let me move quickly to this idea that america cannot settle its issues of financial concern before the fiscal deadline. and see there is no cliff, because as we all well know, the simple premise of making sure that we have tax cuts for

susan rice, the u.n. ambassador who ran into a lot of criticisms from republicans over the benghazi matter, had taken herself out of the running. so pretty much john kerry was the only candidate. the question is, what happens to the rest of the national security team. i haven't gotten any word yet as to whether there is a defense secretary replacement for leon panetta, but we do know john kerry is going to be named secretary of state by the president today. >> john, another question, of course, is what happens to that senate seat in massachusetts, does scott brown choose to run again and move that senate seat from the democratic column to the republican column? any insights this? >> well, that's certainly a possibility. scott brown hasn't ruled that out. but you have a democratic governor there who has talked about a number -- or there's been speculation about a number of people who could be candidates for that seat. either by appointment or in the special elections. don't know how quickly the special election would take place, but everybody from barney frank to young ted kennedy, t
